These Terms of Service (“Terms”) are a binding agreement between you and HadalCore LLC, a limited liability company incorporated in the State of Tennessee, United States (“HadalCore,” “we,” “us,” or “our”). WaitWHO is the trade name we use for our website at https://waitwho.app, the WaitWHO mobile application, and any related media, features, or services we offer (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. Additional terms may apply to specific features; those terms are incorporated by reference when we post them.
1. Agreement to Terms
You represent that you have the authority to enter these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.
We may update these Terms from time to time. We will revise the “Last updated” date above when we do. Material changes may also be communicated through the Services or by email where appropriate. Your continued use after the effective date of updated Terms constitutes acceptance, except where applicable law requires additional consent.
2. Eligibility and Age Requirement
The Services (offered under the WaitWHO name) are intended only for adults. You must be at least 18 years old to use the Services. If you are not 18 or older, you may not access or use the Services.
You must not upload images that depict minors (any person under 18), or use the Services to search for, monitor, or profile minors.
3. Description of Service
We provide tools through the Services that may help you discover publicly available images that appear visually similar to an image you provide, along with related features such as account management, subscriptions or credits, optional monitoring or alerts, and educational materials.
The Services are not tailored to regulated industries (for example, HIPAA or FISMA). If your use would be subject to such laws, you must not use the Services in a manner that would violate those laws.
4. Facial Similarity Search Disclaimer
We provide visual similarity search tools through the Services that may help users discover publicly available images that visually resemble an uploaded photo. We do not verify identity, confirm that any result depicts the same person, or guarantee that results are accurate, complete, current, or relevant.
Search results may include false positives, lookalikes, outdated pages, removed content, duplicate results, or unrelated images. Any match score, confidence score, exposure label, risk indicator, or similar metric is provided for informational purposes only and must not be treated as identity confirmation or a definitive assessment of risk, harm, or wrongdoing.
You are solely responsible for reviewing results carefully and for how you use any information returned by the Services.
No emergency or safety decisions. Do not use WaitWHO results to confront, accuse, threaten, or make safety decisions about any person. If you believe you or someone else is in danger, contact appropriate emergency services or qualified professionals.
5. User Responsibilities and Scan Consent
When you start a scan or similar feature, you confirm that: (a) you are 18 or older; (b) the uploaded image does not depict a minor; (c) you have the right and, where required, consent to use the image for this purpose; and (d) you will use results responsibly and lawfully.
You are responsible for compliance with all applicable laws, regulations, and third-party platform rules in your jurisdiction. You will not use the Services for unlawful surveillance, harassment, discrimination, or other prohibited purposes described below.
6. Prohibited Uses
You agree not to use the Services to:
- upload images of anyone under 18 years old, or use the Services if you are under 18;
- search for, track, or profile someone without proper authorization where authorization is required;
- harass, stalk, threaten, intimidate, shame, blackmail, extort, or exploit any person;
- conduct surveillance or covert monitoring in violation of law or a person’s reasonable expectation of privacy;
- make decisions about employment, housing, credit, insurance, education, eligibility for benefits, or similar high-impact decisions;
- identify, profile, or target people based on protected characteristics where prohibited by law;
- create databases, dossiers, watchlists, or profiles about individuals in violation of law or these Terms;
- circumvent privacy settings, authentication, rate limits, or technical access controls;
- upload unlawful, exploitative, abusive, or non-consensual intimate imagery;
- interfere with or disrupt the Services, other users, or underlying networks;
- reverse engineer, decompile, or attempt to extract source code except where applicable law expressly permits;
- scrape, harvest, or systematically collect data from the Services without our written permission;
- misrepresent your identity, impersonate others, or create accounts by automated or fraudulent means;
- violate any applicable law, regulation, or third-party right.
Violations may result in suspension or termination without refund, and may be reported to platforms or authorities where appropriate.
7. Uploaded Images and User Content
You retain ownership of content you submit, subject to the licenses below. You represent that your uploads do not infringe third-party rights and that you have any necessary permissions for identifiable individuals where applicable.
To operate the Services, you grant HadalCore LLC a non-exclusive, worldwide, royalty-free license to host, process, transmit, display, and create technical derivatives solely as needed to provide, secure, troubleshoot, and operate the Services, comply with law, and enforce these Terms. Processing may involve our systems and third-party providers as described in our Privacy Policy.
You may not upload content you do not have rights to use. We may remove or restrict content that violates these Terms or applicable law.
8. Third-Party Search Providers and Websites
The Services may rely on third-party search providers, indexes, APIs, and publicly available websites. Those third parties are not controlled by us. Their terms and privacy policies may apply to your use of their services or data they return.
Third-party providers may process uploaded images and related technical data according to their own policies, retention periods, and security practices. We do not control their databases, indexing, crawling, result ranking, or any opt-out, removal, or delisting processes they may offer.
Links or references to third-party sites do not imply endorsement. You access third-party sites at your own risk.
9. Search Results, Accuracy, and No Identity Confirmation
Results are provided “as is.” We do not warrant that results are accurate, complete, timely, lawful, or free from error. Visual similarity does not establish identity, location, conduct, or facts about any person.
You are solely responsible for any actions you take based on results, including any interactions with individuals or third parties.
10. Subscriptions, Credits, Billing, and Renewals
We may offer one-time credits, subscriptions, or other paid features. Credits are consumed when you run eligible searches or use paid features, according to in-product disclosures at the time of purchase or use.
Subscription plans may include a recurring allowance (for example, weekly or monthly credits or scans). Unless we expressly state otherwise, allowances refresh each billing period and unused credits or scans do not roll over.
Apple App Store. If you purchase through Apple, billing, renewal, cancellation, and refunds are processed by Apple under Apple’s policies and your Apple account settings. We do not control Apple’s payment systems. Refund requests must be submitted through Apple where applicable.
Deleting the app does not cancel a subscription. To cancel a subscription purchased through Apple, you must use your Apple account subscription settings (or the cancellation path Apple provides).
Prices and features may change. Taxes may apply. If a payment fails or is reversed, we may suspend paid features until resolved.
11. Premium Monitoring and Alerts
Optional monitoring, rescans, notifications, or alerts may be offered on a best-effort basis. Delivery may be delayed or prevented by device settings, network conditions, third-party provider outages, platform policies, or maintenance. We do not guarantee uninterrupted delivery, timeliness, or detection of any particular content.
12. Privacy Policy
Our Privacy Policy describes how we collect, use, share, and retain information. By using the Services, you agree to the Privacy Policy, which is incorporated into these Terms.
13. Intellectual Property
HadalCore LLC and its licensors own the Services, including software, branding, text, graphics, and related intellectual property, except for your content and third-party materials. Except for the limited rights expressly granted in these Terms, no rights are granted to you.
If you provide feedback or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback without obligation to you.
14. Mobile Application License
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the mobile app on devices you own or control. You may not copy, modify, distribute, sell, lease, or create derivative works of the app except as permitted by law.
15. App Store Terms (Apple)
If you obtain the app from Apple’s App Store, you agree to comply with Apple’s applicable terms (including usage rules). Apple is not responsible for the Services or support, except as required by Apple’s policies. Apple has no obligation to furnish maintenance or support for the app. Apple is a third-party beneficiary of this section solely as needed to enforce these Terms against you.
16. Safety Guides and Educational Content
Guides, FAQs, blog posts, and similar materials are provided for general information only. They are not legal, medical, or professional advice. Laws vary by location; you should consult qualified professionals for advice specific to your situation.
17. Account Suspension and Termination
We may suspend or terminate access to the Services at any time, with or without notice, if we reasonably believe you violated these Terms, pose a risk to others, or must do so for legal, security, or operational reasons.
You may stop using the Services at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, indemnity, and governing law) will survive.
18. Service Changes and Availability
We may modify, suspend, or discontinue features or the Services, in whole or in part. We may perform maintenance that causes downtime. We are not liable for any modification, suspension, or discontinuance, except where applicable law requires otherwise.
19. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be error-free, secure, or uninterrupted, or that results will meet your expectations. Some jurisdictions do not allow certain disclaimers; in those jurisdictions, disclaimers apply to the fullest extent permitted.
20. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HADALCORE LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO HADALCORE LLC FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50).
These limitations do not apply where prohibited by law, including liability for gross negligence, fraud, or intentional misconduct to the extent such exclusions are not permitted.
21. Indemnification
You will defend, indemnify, and hold harmless HadalCore LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your content or uploads; (c) your violation of these Terms or law; or (d) your interactions with third parties based on results or information obtained through the Services.
22. Governing Law and Venue
These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict-of-law principles that would require application of another jurisdiction’s laws, except that consumer protection laws in your country of residence may apply to the extent they cannot be waived by contract.
Except where prohibited by applicable law, you and HadalCore LLC consent to the exclusive jurisdiction and venue of the state and federal courts located in Tennessee for disputes arising out of these Terms or the Services.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
23. Changes to These Terms
We may update these Terms to reflect changes to the Services, law, or business practices. If an update is material, we will take reasonable steps to notify you (for example, in-app notice or email). If you do not agree to updated Terms, stop using the Services.

Electronic communications
You consent to receive communications from us electronically (for example, email or in-app notices). You agree that such communications satisfy any legal writing requirements to the extent permitted by law.
Miscellaneous
These Terms, together with the Privacy Policy and any additional terms for specific features, are the entire agreement between you and HadalCore LLC regarding the Services. If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
Get the App
